General Terms and Conditions – The Garcia Sisters

Welcome to Clara Pieces .  These terms and conditions apply to all contracts entered into with Clara Pieces. By placing an order, you agree to these terms and conditions. For any questions, you can contact us at hello@clarapieces.com . 


Article 1 – Definitions

Under these general conditions, the following definitions apply:

  • Withdrawal period : period in which the consumer can exercise their right of withdrawal.
  • Consumer : a natural person acting for purposes unrelated to their commercial or professional activity.
  • Day : natural day.
  • Fixed-term contract : a contract with a limited duration related to several products or services.
  • Durable media : a medium that allows information to be stored for future reference without changes.
  • Right of withdrawal : the consumer's right to cancel the distance contract within the legal period.
  • Company : natural or legal person that offers products or services remotely.
  • Distance contract : a contract concluded without physical presence, through remote communication.
  • Remote means of communication : a tool that allows a contract to be concluded without simultaneous physical presence.
  • General conditions : the present conditions of the company.

Article 3 – Scope of application

These conditions apply to all offers and orders made through the online store, as well as to all distance contracts between the company and consumers.

The terms and conditions will be available before the contract is concluded. If this is not possible, instructions will be given on how to access them and that they can be sent free of charge.

If additional conditions apply, these will also be valid. In case of conflict, the condition most favorable to the consumer will apply.

The invalidity of a clause will not affect the validity of the rest of the contract. The invalid provision will be replaced by another that is as equivalent as possible.

Unforeseen or unclear cases will be interpreted in accordance with these conditions.


Article 4 – Offer

If an offer is time-limited or subject to conditions, this will be expressly stated.

The offer is not binding. It may be modified at any time.

The product descriptions are accurate. The images realistically reflect the products. Obvious errors are not binding.

There may be color differences between the images and the actual products.

Each offer contains clear information about:

  • The price (excluding import duties and VAT, which are the responsibility of the customer)
  • Shipping costs
  • How the contract is concluded
  • Right of withdrawal
  • Payment methods, delivery and contract duration
  • Offer validity period
  • Additional costs for remote communication
  • Contract storage and access by the consumer
  • Possibility of correction before purchase
  • Languages available for the contract
  • Applicable codes of conduct
  • Minimum duration for continuous contracts
  • Available sizes, colors, and materials (if applicable)

All orders are shipped via standard shipping from a country outside the European Union (e.g., China). Delivery is made according to the standard postal or courier service.

Import VAT and, where applicable, customs duties must be paid by the consumer to the relevant courier service (e.g., Correos, DHL or SEUR) at the time of delivery.

The company expressly states that these costs are not included in the purchase price and are calculated according to the customs regulations in force in the destination country.


Article 5 – Conclusion of the contract

The contract is formalized when the consumer accepts the offer and complies with the conditions.

For online orders, receipt is confirmed immediately. If there is no confirmation, the consumer can cancel the contract.

The company will adopt appropriate security measures to protect the data.

Credit checks may be carried out. In case of justified doubts, the order may be cancelled or subject to conditions.

After the contract is signed, the consumer will receive confirmation with the essential information.

If a product is unavailable, the contract is subject to availability.


Article 6 – Right of withdrawal

The consumer can cancel their purchase within 30 days of receipt, without needing to provide a reason.  

During this period, the product must be handled with care. It may only be opened or used as necessary to check its condition.

To exercise this right, you must notify us in writing or by email and return the product within the deadline.

If the product is not returned, the contract remains valid.


Article 7 – Costs in case of withdrawal

Return costs are the responsibility of the consumer.

Payments already made will be refunded within 14 days of receiving the return.


Article 8 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

  • Customized or made-to-order products
  • Perishable or personal items
  • Products sealed for hygiene; if the seal has been opened
  • Audio/video recordings or software with the seal broken

This also does not apply to services such as:

  • Trips, transportation, or events with a fixed date
  • Services initiated with the consumer's consent before the end of the withdrawal period

Article 9 – Prices

Prices are valid for the duration of the offer, except for changes in VAT.

If the price depends on the market, it will be indicated.

Price increases within 3 months are only permitted by law.
After 3 months, they are only permitted with the consumer's consent.

All prices are subject to change. No claims will be accepted for typographical or other errors.


Article 10 – Warranty

The company guarantees that the products comply with the contract and current regulations.

The legal guarantee is not affected.

Any defects must be reported within 14 days of receipt.

The warranty does not cover misuse or tampering by the customer.


Article 11 – Delivery

Delivery is made to the address indicated by the customer.

In case of delay or lack of availability, the customer will be informed within 30 days and may cancel the purchase.

If cancelled, the amount will be refunded within 14 days.

In case of unavailability, an equivalent product may be sent.

Shipments are made from our warehouse in Asia.


Article 12 – Duration and cancellation of contracts

Indefinite-term contracts can be cancelled with 1 month's notice.

Limited-time contracts end automatically, unless renewed by mutual agreement.

Tacit renewal of long-term contracts is not permitted.


Article 13 – Payment

Errors in payment details must be reported immediately.

In case of non-payment, reminder fees may apply.


Article 14 – Claims

Claims must be submitted within 7 days of the problem being detected.

The company will respond within a maximum of 14 days.


Article 15 – Applicable legislation

German law will apply exclusively.


Article 16 – CESOP

Payment providers may report certain transactions to the CESOP (Centralized European Payment System) system, in accordance with the new legal regulations.
